Terms of Service
(Reference Translation)

Article 1 (Application)
These Terms of Service (“Terms”) set forth the conditions for use of the iOS subscription-based anime-style image generation application (“the App”) provided by the Developer (“we”, “us”, “our”).
By installing the App, users (“User” or “Users”) are deemed to have agreed to these Terms and shall use the App in accordance herewith.

Article 2 (Definitions)

  • “App” refers to the iOS subscription-based application that generates images using AI technology when a User selects their own photos.
  • “User” refers to any individual or entity who installs the App and agrees to these Terms.
  • “Subscription” refers to the recurring payment contract registered via the App Store for accessing paid features of the App.

Article 3 (Commencement of Use)
Registration and cancellation of Subscriptions within the App shall be handled via the App Store’s subscription management functions.

Article 4 (Subscription and Fees)
Users wishing to access paid features of the App must use the App Store’s subscription service and pay the fees specified by us.
The terms and procedures for subscription registration and cancellation shall be governed by the App Store’s policies.

Article 5 (Features Provided)
Users may submit image generation requests up to a maximum number of times as determined by us. This maximum number may be changed depending on operational circumstances.
Subscribed Users may submit more generation requests than non-subscribed Users.
The features and functions of the App may be changed, added, or discontinued without notice due to technical or operational reasons.

Article 6 (Prohibited Conduct)
Users must not engage in any of the following when using the App:

  • Uploading or using images that infringe on the copyrights, image rights, privacy, or other rights of third parties
  • Using photos as source material that are illegal or contrary to public order and morals
  • Using generated images for purposes that are contrary to public order and morals
  • Obstructing the operation of the App or interfering with other Users’ use
  • Reverse engineering, modifying, or decompiling the App’s software
  • Engaging in unauthorized access or actions that promote such access
  • Any other actions deemed inappropriate by us
    Users represent and warrant that they hold all necessary rights, including copyrights, for any photos uploaded or submitted for generation, and agree not to use images for which they do not have such rights.

Article 7 (Handling of User Content)
We transmit Users’ image data to an AI service provider. We do not retain any such data ourselves.

Article 8 (Intellectual Property Rights)
All rights to the App’s programs, UI designs, logos, trademarks, documents, and any other information (“Resources”) belong to us or the legitimate rights holders.
Users shall not reproduce, modify, redistribute, or adapt these Resources.

Article 9 (Disclaimer and Limitation of Liability)
Due to the nature of AI algorithms, we do not guarantee that generated images will always meet Users’ expectations.
We shall not be liable for any damages incurred by Users or third parties arising from use of the App, except in cases of intentional or gross negligence on our part. In such cases, our liability shall be limited to the total amount of fees paid by the User to us for the App within the past one month.
The service may be suspended for maintenance or updates.

Article 10 (Handling of Personal Information)
We will use any personal information obtained only for operating the App and for purposes described in our separate Privacy Policy.
Management and protection of personal information shall be governed by the contents of our Privacy Policy.

Article 11 (Changes, Suspension, and Termination of the Service)
We may change, interrupt, suspend, or terminate the provision of the App without prior notice.

Article 12 (Amendment of the Terms)
We may revise these Terms as necessary.
Continued use of the App after any changes shall be deemed as acceptance of the revised Terms.

Article 13 (Governing Law and Jurisdiction)
These Terms shall be interpreted under the laws of Japan.
Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the Nagoya District Court or the Nagoya Summary Court as the court of first instance.

Supplementary Provision:
These Terms of Service shall come into effect as of May 2, 2025.

利用規約

第1条（適用）

  1. 本規約は、開発者（以下「当社」）が提供するiOS向け定期購読型アニメ風画像生成アプリ（以下「本アプリ」）の利用条件を定めるものです。
  2. ユーザーは本アプリをインストールした時点で本規約に同意したものとみなし、本アプリを利用するものとします。

第2条（定義）

  1. 「本アプリ」とは、ユーザーが手持ちの写真を選択すると、AI技術により画像を生成するiOS向け定期購読型アプリをいいます。
  2. 「ユーザー」とは、本アプリをインストールし、当該利用規約に同意した個人または法人をいいます。
  3. 「サブスクリプション」とは、App Storeを通じて本アプリの有料機能を利用するためにユーザーが登録する定期購読契約をいいます。

第3条（利用開始）

  1. 本アプリにおけるサブスクリプションの登録および解約は、App Storeのサブスクリプション管理機能を通じて行われます。

第4条（サブスクリプションおよび利用料）

  1. ユーザーが本アプリの有料機能を利用する場合、App Storeのサブスクリプション機能を利用し、当社が定める利用料を支払うものとします。
  2. サブスクリプションの契約および解約は、App Storeが定める手続きおよび条件に準拠して行われるものとします。

第5条（提供機能）

  1. ユーザーは、当社が定める上限枚数まで生成リクエストが可能です。上限枚数は運営状況に応じて変動があります。
  2. サブスクリプション登録済みのユーザーは、非登録のユーザーよりも多くの枚数まで生成リクエストが可能です。
  3. 本アプリの機能内容は、技術的・運用的理由により予告なく変更・追加・廃止することがあります。

第6条（禁止事項）

ユーザーは本アプリの利用にあたり、以下の行為を行ってはなりません。

  1. 他者の著作権、肖像権、プライバシーその他権利を侵害する画像をアップロード・使用する行為
  2. 違法または公序良俗に反する写真を素材として使用する行為
  3. 生成された画像を公序良俗に反する目的で利用する行為
  4. 本アプリの運営を妨害し、または他のユーザーの利用を妨げる行為
  5. 本アプリのソフトウェアをリバースエンジニアリング、改変、逆コンパイルする行為
  6. 不正アクセス行為およびそれを助長する行為
  7. その他当社が不適切と判断する行為
  8. ユーザーは、アップロードまたはリクエストする写真について、自己が著作権その他一切の利用権利を有していることを表明・保証し、権利を有しない画像を使用しないこと。

第7条（ユーザーコンテンツの取り扱い）

  1. 当社は、ユーザーの画像データをAI運営会社に送信し、当社は当該データを一切保持しません。

第8条（知的財産権）

  1. 本アプリに関するプログラム、UIデザイン、ロゴ、商標、ドキュメントその他一切の情報（以下「本リソース」）の権利は当社または正当な権利者に帰属します。
  2. ユーザーは本リソースを複製・改変・再配布・翻案してはなりません。

第9条（免責事項および賠償責任の制限）

  1. 本アプリの生成結果はAIアルゴリズムの特性上、必ずしも期待どおりの品質を保証するものではありません。
  2. 当社は、本アプリの利用によりユーザーまたは第三者が被った損害について、一切責任を負いません。ただし、当社の故意または重過失による場合に限り責任を負うものとし、その損害賠償責任の上限は、ユーザーが過去1ヶ月間に本アプリの利用料として当社に支払った総額とします。
  3. システム保守・更新等に伴いサービスを停止する場合があります。

第10条（個人情報の取扱い）

  1. 当社は取得した個人情報を、本アプリ運営および別途定める「プライバシーポリシー」に記載の目的のみに利用します。
  2. 個人情報の管理・保護については、プライバシーポリシーの内容に従います。

第11条（サービスの変更・停止・終了）

当社は予告なく本アプリの提供を変更、中断、停止または終了することがあります。

第12条（規約の変更）

  1. 当社は必要に応じて本規約を変更できるものとします。
  2. 変更後、本アプリ利用の継続によりユーザーは変更後の規約に同意したものとみなされます。

第13条（準拠法・裁判管轄）

  1. 本規約の解釈には日本法を適用します。
  2. 本アプリに関して紛争が生じた場合、名古屋地方裁判所または名古屋簡易裁判所を第一審の専属的合意管轄裁判所とします。

附則 本規約は2025年5月2日より施行します。
